A while back, I was investigating the thought of offering my services to the legal community as a mediator. My initial expectation was that, as a litigator for 23 years who negotiated too many settlements to count and had participated in a tremendous number of court mandated conciliations, dispute resolution was what I had been doing for a living. I was skeptical that additional training would offer any insight I had not already acquired over the years. I was wrong!

Welcome to our first Newsletter of 2007!  This edition will continue our discussion of the development of alternative dispute resolution methods for healthcare claims – but with an interesting twist.  Let me back up a bit.  Our April, 2006 article, “Patient Relation Initiatives - Claims and Litigation Management - Are They Evolving Together?” dealt with the critical elements of early resolution.   One of the essential issues was the need to make the proactive resolution of claims part of the new culture that at so many healthcare providers are striving to achieve.
